House Bill 2322

CONDOMINIUMS; COMMERCIAL STRUCTURES; RESIDENTIAL STRUCTURES

Requires that any common expenses in a condominium with separate commercial and residential structures be allocated based on the benefit to each structure. Expenses exclusively benefiting a commercial structure must be assessed only to the commercial units, while those benefiting a residential structure must be assessed only to the residential units. Expenses benefiting both structures must be proportionally allocated between them and assessed on a pro rata basis. Places the burden of proof on the condominium association to demonstrate compliance with these allocation requirements in case of disputes. Applies to all condominiums existing on or after the effective date of this legislation.

House Bill 2442

HOMEOWNERS’ ASSOCIATIONS; BUDGET RATIFICATION; REQUIREMENTS

Requires the board of directors of homeowners’ associations (HOAs) and condominium associations to develop and adopt annual operating budgets based on a reasonable and good faith estimate of anticipated common expenses. If the proposed budget results in an annual assessment increase exceeding the consumer price index percentage for the prior 12 months, it must be ratified by a majority of unit owners or members. Noncompliance with these requirements renders actions or assessments invalid. HOAs are authorized to establish reserve accounts to address anticipated long-term or major maintenance and upgrade of common elements.

House Bill 2723

MUNICIPALITIES; ASSOCIATIONS; RESTRICTIONS

Prohibits homeowners’ associations established after the effective date of this legislation from adopting regulations or restrictions that are more restrictive than existing municipal regulations or restrictions if the association was required by a municipality as a condition of development approval.

House Bill 2865

HOMEOWNERS’ ASSOCIATIONS; ATTORNEY FEES

Prohibits condominium and homeowners’ associations (HOAs) from charging or assessing attorney fees and related costs to individual unit owners, members, or former members. Requires all parties in litigation, arbitration, mediation, administrative action, or other claims to bear their own attorney fees and costs, except when the HOA’s governing documents allow a unit owner or member to recover such costs from the HOA.

House Bill 2866

HOMEOWNERS’ ASSOCIATIONS; UNLAWFUL ENFORCEMENT; DAMAGES

Condominium and homeowners’ associations (HOAs) that attempt to enforce unlawful provisions in their governing documents are liable for damages to the unit owner, in an amount of $1,000 for the first attempt to enforce, $10,000 for the second, and $100,000 for the third and subsequent attempts. Liability accrues regardless of whether enforcement is attempted against the same or different members. Grants unit owners and members the right to pursue damages in court.

Senate Bill 1039

HOMEOWNER’S ASSOCIATIONS; MEETINGS; RECORDINGS

Requires homeowners’ associations (HOAs) to retain unedited audio or video recordings of their meetings for at least six months and to provide these recordings to any HOA member upon request.

Senate Bill 1337

HOMEOWNER’S ASSOCIATIONS; VIOLATIONS; NOTICE

Allows homeowners’ associations (HOAs) and condominium associations to accept electronic submissions for responses to violation notices. Requires violation notices to include that members may petition for a hearing on violations.

Senate Bill 1378

POLITICAL SIGNS; HOMEOWNERS’ ASSOCIATIONS

Protections for political signs in homeowners’ associations and planned communities include flags and include signs and flags supporting or opposing a public officer or candidate without regard to whether the person is on the ballot at the next upcoming election, except for a sign for a candidate in a primary election who does not advance to the general election.

Senate Bill 1494

COMMON EXPENSE LIENS; FORECLOSURE; AMOUNT

Increases the minimum amount of unpaid assessments required for a homeowners’ association to initiate foreclosure to $2,000, from $1,200.

Senate Bill 1535

HOMEOWNER’S ASSOCIATIONS; ADDRESS LIGHTS

Prohibits homeowners’ associations and condominium associations from restricting the installation or use of lighted home address devices that display the house number, flash red and blue when activated, are visible from the street, and have a low-light adjustment. Allows associations to impose reasonable placement and lighting restrictions as long as they do not prevent, impair, or unreasonably increase the cost of the device.
